In order to work in Thailand, a person has to legally obtain both a Non-Immigrant Visa Category “B” and a Work Permit.  Let’s talk about Non-Immigrant Visa Category “B” or a Non-Immigrant Visa Category “B-A” or a Non-Immigrant Visa “IB” first because this is what you have to obtain first before you could apply for a work permit.


What is the difference between Non-Immigrant Visa Category “B” or a Non-Immigrant Visa Category “B-A” or a Non-Immigrant Visa “IB” or Non-Immigrant Visa “IM”?
Non-Immigrant Visa Category “B”  (Business Visa)   is issued to applicants who wish to enter the Kingdom to work or to conduct business will apply to Royal Thai Embassy directly. The holder of this Non-Immigrant Visa Category “B” visa will be permitted to stay for a period of 1 year from the date of the first entry into Thailand.
Non-Immigrant Visa Category “B-A” (Business Visa) is the granting of such visa to qualified applicants is under the jurisdiction of the Office of the Immigration Bureau in Bangkok.  The applicant’s associated company in which he or she will invest in or conduct business with may apply for this type of visa on behalf of the applicant at the Office of the Immigration Bureau.  Once the application is approved, the Immigration Bureau will advise the concerned Royal Thai Embassy or Royal Consulate-General via the Ministry of Foreign Affairs to issue the visa to the applicant.  The holder of this category “B-A” visa will be permitted to stay for a period of 1 year from the date of first entry into the Kingdom.
Non-Immigrant Visa “IM” (Investment and Ministries) is a visa granted to for investor with the concurrence of the Thai Ministries and Government Departments concerned. The applicant’s associated company in which he or she will invest in or conduct business with Thai Ministries and Government Departments.  The duration of this particular visa applicant is from 1 year depending on the Thailand Board of Investment discretion.
Non-Immigrant Visa “IB” visa (Investment and Business Visa) applicant must seek an approval from Thailand Board of Investment (BOI) first before being eligible to apply for this type of visa. The information is as per the Investment and Business Visa. The duration of this particular visa applicant is from 1 year up to duration of 8 years depending on the Thailand Board of Investment discretion.
Who is eligible for a Non-Immigrant Visa Category “B”?
If you wish to conduct your own business in Thailand or become an employee in a business, you are eligible for a Non-Immigrant Visa Category “B”. For a Non-Immigrant Visa Category “B”, there are two Categories of entry which is the 90 Days Non-immigrant Visa (Single Entry) or the 1 year Non-Immigrant Visa (Multiple-Entry) in Thailand.
What are the requirements to be eligible to conduct a Business in Thailand or applicant for a Non-Immigrant Visa Category B?
The requirements of an applicant for applying a Business visa or Non-Immigrant Visa Category B  includes:

  • Applicant shall have either a partnership or a company formed in Thailand.
  • Applicant not prohibited from entering the Kingdom as provided by the Immigration Act B.E. 2522 (1979).
  • Applicant must not have any criminal record in Thailand and the country of the applicant’s nationality or residence.
  • Applicant must not carry prohibitive diseases including but not limited to Leprosy, Tuberculosis, drug addiction, Elephantiasis, third phase of Syphilis as indicated in the Ministerial Regulation No. 14 B.E. 2535.

What are the documents needed to apply for a Business Visa in Thailand?
The applicants must submit the following relevant documents depending on the purpose of their visit.

  • Passport or travel document with validity of not less than 6 months or 18 months validity period for or the 1 year Non-Immigrant Visa (Multiple-Entry).
  • Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months.
  • Evidence of adequate finance for the duration of the stay showing either 20,000 Baht (610USD) per person or 40,000 Baht (1220 USD) per family including either a bank statement or deposit.
  • Itinerary of the applications stay. (if have)
  • Evidence of financial status in the case where the applicant is self-employed.
  • Official letter of invitation from trading or associated partners/companies in Thailand.
  • Corporate documents of partners/company in Thailand includes submitting the following documents:
                    1) business registration and business license
                    2) list of shareholders
                    3) company profile
                    4) details of business operation
                    5) list of foreign workers stating names, nationalities and positions
                    6) map indicating location of the company
                    7) balance sheet, statement of Income Tax and Business Tax (Por Ngor Dor 50 and Por Ngor Dor 30 of the latest year)
                   8) value-added tax registration (Por Por 20)

        9) Document indicating the number of foreign tourists (for tourism business only), or document indicating export transactions issued by banks (for export business only).
** Copies of company documents must be signed by Board of Directors and affixed the seal of the company.
** The applicant must sign on each page of the copy.
** Documents in foreign languages must be translated into Thai or English and properly notarized by notary organs or the applicant’s diplomatic/ consular mission.
**All documentation is subjected to the Royal Thai Embassy request, and the Royal Thai Embassy request for more documentation.

What is the validity of the Business Visa?
A Business Visa is valid for a period of either 90 days (single entry) or a period of 1 year (multiple entries) but upon first entry into the Kingdom of Thailand or a period of 36 months from the date of issue. For the 1 year (multiple entries) or the 3 year (multiple entries), the applicant must report every days to the official of Thailand.  
How do I report after 90 days?
After 90 days, the applicant or visa holder is subjected to report to the police or Royal Thai Embassy of your visitation. However, the applicant or visa holder is able to report either personally or by letter.
How about my spouse or children after I apply for a Business Visa?
Upon submission of the applicant Business Visa, the applicant spouse or children is eligible to apply for a Dependent Visa.
What are the documents used to apply for a Dependent Visa?
The dependent visa document is as follow:
1. Applicant passport valid not less than 6 months. The validity of 18 months is
required for one-year visa application.
2. Copy of passport.
3. Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months.
4. Original and copy of official marriage certificate (For spouse).
5. Original and copy of official birth certificate (For children).
6. Documents required from Company or partnership/company in Thailand:
1)  Letter indicating applicant’s name, passport number and the relationship with company’s employee, requesting for   Non-immigration Category ‘O’ visa
2) Copy of the company’s registration.
3)  Copy of the company’s list shareholders
4)  Copy of the company’s latest balance sheet.
5)  Copy of the company’s registration of value-added tax (VAT).
7. Copy of the work permit (if any).
** Copies of company documents must be signed by Board of Directors and affixed the seal of the company.
** The applicant must sign on each page of the copy.
** Documents in foreign languages must be translated into Thai or English and properly notarized by notary organs or the applicant’s diplomatic/ consular mission.
**All documentation is subjected to the Royal Thai Embassy request, and the Royal Thai Embassy request for more documentation.
